Rosales joins Rangers, Anderson update and Friday?s lineup vs. Texas

Adam Rosales, designated for assignment for Wednesday, will remain at the Coliseum for three more days ? with the Rangers. Texas claimed the utilityman off waivers Friday morning.

A?s assistant general manager David Forst gave Rosales the news.

?I was really shocked, but excited at the same time,? Rosales said. ?Obviously bittersweet. I was with the A?s for four years. (I) feel like I grew up a lot with them. But it?s great. I?m ready for this new chapter in my baseball life.?

A?s manager Bob Melvin spoke with Rosales on Friday afternoon. Melvin admitted it was a ?little weird? for both Rosales and the A?s.

?It?s weird for us,? Melvin said. ?We have to change our signs now.?

With their signs presumably changed, this is the A?s lineup to face Texas right-hander Alexi Ogando (4-3, 3.05): Crisp, CF; Sogard, 2B; Lowrie, SS; C?spedes, LF; Moss, 1B; Donaldson, 3B; Reddick, RF; Smith, DH; Norris, C.? Tommy Milone (9-8, 4.03) is on the mound for Oakland.

Anderson update: Brett Anderson threw live batting practice early Friday; Melvin estimated Anderson threw 55-58 pitches (including about 25 warm-up throws).? ?It looked like everything went smoothly to me,? Melvin said, ?and no complaints from him as far as physically.? The A?s will wait until they see how Anderson feels Saturday before announcing the next step for him on his rehab from a foot injury.

Other items of interest: Melvin said the A?s probably will stay on turn in their rotation even with three off-days in an eight-day stretch. One reason not to skip anyone: to give Bartolo Colon two extra days of rest. Melvin said Colon?s velocity has been down in each of his past three starts. ? John Jaso remains on the concussion disabled list. Melvin said the catcher will undergo some tests Saturday. ? Texas optioned outfielder Engel Beltre to Triple-A to make room for Rosales on the roster.

Brazilian President's October Visit: The Right Time for a Brazil-U.S. Tax Treaty?

While Brazilian president Dilma Rousseff?s state visit may be just under three months away, and given the normal sluggishness of the U.S. government?s interagency process in preparations, now is the time to start thinking about what the Obama administration wants to achieve. Brazil has been the focus of considerable attention lately, with mass protests, the Papal visit, and build-up for both the 2014 World Cup and the 2016 Olympics garnering countless headlines. Given the South American country?s potential in world affairs, it should come as no surprise that the United States is continuing efforts to increase ties with Brazil.

Over the last two years, the Obama and Rousseff administrations have made efforts to increase high level engagement. In May, Vice President Joe Biden traveled to Brasilia, where he extended a state visit invitation to Rousseff and shared his vision of making 2013 the ?start of a new era of Brazil-U.S. relations.? Now, the White House looks to greet President Rousseff for an official state dinner on October 23.

Rousseff?s trip will mark the first official state visit by a Brazilian president since Fernando Henrique Cardoso journeyed to the White House in 1995, and the first state visit of Obama?s second term. The trip could provide a unique opportunity for Brazil and the United States to develop substantive, long-lasting initiatives that advance both countries? economic goals to achieve mutual prosperity.

Despite growing trade, investment, and economic ties between the two countries, until recently there appeared to be little appetite in Brazil for implementing a bilateral free trade agreement (FTA) or a bilateral investment treaty any time soon.

But a combination of factors, including a marked drop in President Rousseff?s popularity as a result of weeks of sustained protests and the United States? and other regional partners? moving forward on an assortment of trade deals, including the Trans-Pacific Partnership (TPP), the Pacific Alliance, and the Transatlantic Trade and Investment Partnership (T-TIP) with the European Union, have left Brazil, as one politician mentioned, "outside of the party, and dancing alone at home."

This situation creates an opportunity for Brazil to reconsider deeper commercial cooperation with the United States, and the timing of the October visit could not be better.

The conclusion of a bilateral tax treaty is still a very ambitious proposal, but more realistic in this context. The start of serious negotiations on a tax treaty should be a priority, and the outcome, of October?s visit.

But why is a bilateral tax treaty a good first step in institutionalizing growing bilateral economic cooperation between the United States and Brazil?

Q1: What would the bilateral tax treaty do, and why is it beneficial?

A1: A tax treaty provides exemptions from taxes or reduced tax rates that eliminate double taxation of income, which is currently a major disincentive for U.S. corporations interested in operating or investing in Brazil. In addition, a tax treaty, following the Organization for Economic Cooperation and Development (OECD)?s Model Tax Convention, would address transfer pricing, withholding rates, tax dispute resolution, and tax sparing, facilitating commerce between Brazil and the United States.

By demonstrating a commitment to reducing taxation, a tax treaty will promote cross-border investment. This incentivizes corporations, both small and large, to invest abroad, ultimately making the companies more competitive in each other?s markets. The U.S. Investment Climate Statement of 2012 considered Brazil a friendly environment for foreign investment, but acknowledges that ?burdensome tax and regulatory requirements exist.? The United States and Brazil have both emphasized the importance of deepening cooperation in trade and commerce, and a bilateral tax treaty seems the logical first substantive step in increasing economic output and strengthening investment relations.

Q2: Why is a bilateral treaty not yet in place?

A2: The United States and Brazil have a history of trade disputes and disagreements over tax policies. After signing the bilateral Tax Information Exchange Agreement (TIEA) in 2007, the countries released a joint statement explaining that their divergence ?on a number of important areas of tax treaty policy [makes] the conclusion of a mutually accepted treaty difficult.? Past disputes have also revolved around the enforcement of intellectual property rights in Brazil, agricultural trade, customs, and legal procedures. This has made negotiations between the countries difficult, and even now an FTA or an investment treaty remains unlikely.

Before Obama?s visit to Brasilia in 2011, the potential for a bilateral tax treaty was raised within the U.S. Congress. Then-Senator Richard Lugar submitted a resolution urging President Obama to push for the negotiation of the treaty during his visit. Although some support existed within the U.S. Congress, the fierce debate within the Brazilian Congress over the much simpler Tax Information Exchange Agreement (TIEA) demonstrated that, at the time, Brazil was not prepared for a formal tax treaty with the United States.

Nevertheless, the Brazilian Congress has begun voicing interest in reaching more formal, comprehensive economic agreements with the United States. Brazilian senators originally rejected the TIEA citing its alleged violation of Brazilian constitutional principles?but have since overcome these reservations.

Q3: How can Obama and Rousseff push a tax treaty now?

A3: This March, the U.S.-Brazil TTIEA came into effect. After stalling in the Brazilian Senate for six years, the TIEA now allows the countries to share information on tax collection, helping prevent tax evasion.

The ratification of the TIEA represents an important first step toward a full tax treaty, its approval demonstrating the favorable tax environment developing between the countries. In the current political environment, both the United States and Brazil are in a position to push for more comprehensive tax policies that encourage investment and facilitate trade. This year?s implementation of the TIEA shows attitudes are changing, albeit slowly.

Considering this major advancement, Rousseff?s visit comes at a perfect and critical time. Currently, the United States has tax treaties with over 60 countries in every region of the world; for its part, Brazil has tax treaties with 24 countries.

Brazil is the seventh largest economy in the world, but remains the only one of the top ten economies with which the United States does not yet have a tax treaty in place. The state visit allows the presidents to take advantage of the window of opportunity and momentum granted by the TIEA?s approval to move forward on this issue.

Conclusion: The economic relationship between the United States and Brazil is growing in importance, but ample opportunities exist to strengthen it. Today, Brazil is the United States? ninth largest trade partner, and the state visit highlights U.S. interest and willingness to increase cooperation.

The visit may well provide an opportunity to give a much needed legal framework to the countries? relationship, serving as an excellent channel to push important and timely issues.

The White House should take advantage of momentum within the Brazilian Congress on the TIEA and place the bilateral tax treaty?a tangible deliverable?at the center of the state visit?s agenda.
Should the United States provide enough momentum of its own, Obama and Rousseff may reach a mutually beneficial agreement to push the treaty forward in both congresses.

Though working through the U.S. Congress presents serious challenges, an agreement to promote the tax treaty is a symbol of cooperation which signals an opportunity for the countries to achieve mutual prosperity and increase their global competitiveness?let?s not waste it

Komen foundation to study environmental impact on breast cancer

PEORIA, Ill. -- The Susan G. Komen foundation has announced that millions of dollars in new grants will be used for environmental research.

Five grants totaling $42 million will go towards global breast cancer research, aimed at understanding the role the environment may play in breast cancer development.

With these grants, the foundation has now invested more than $790 million into breast cancer research.

Currently one in eight women will be diagnosed with breast cancer.
????
However, Susan G. Komen officials hope to decrease that statistic with more and more donations every year.

"We have to be able to give some kind of hope. We have to get to the point where every stage of breast cancer is treatable. We need to prevent breast cancer from happening if there is an environmental link. If we can eliminate those risks, then we can also reduce the risk of the disease to begin with," said Susan G. Komen Development Director, Gina Morss-Fischer.

The Komen Memorial Affiliate has many upcoming events to raise local research dollars, like the Bloomington-Normal Race for the Cure on September 14th.

Exxon 2Q profit is lowest since early 2010

NEW YORK (AP) ? Exxon Mobil reported its lowest quarterly profit in more than three years, as the oil and gas giant again struggled to boost production and results from its refining operations weakened.

Net income fell 57 percent in the second quarter. Exxon said Thursday that it earned $6.86 billion, down from $15.9 billion in the year-ago quarter, which included a gain from the sale of a Japanese lubricants division and other assets. Even without those year-ago gains, Exxon's net income fell 19 percent.

On a per-share basis Exxon earned $1.55. Analysts polled by FactSet expected Exxon to earn $1.90 per share.

Exxon shares fell $1.03 to close at $92.72, on a day when 24 of the 30 stocks in the Dow Jones industrial average moved higher.

Exxon's revenue fell 16 percent in the second quarter to $106.47 billion from $127.36 billion a year earlier.

Exxon pointed a finger at the global economy, saying growth in the U.S. remained sluggish, the Chinese economy grew slower than expected and Europe remained weak. This helped lower the average price of Brent crude, a benchmark used to price international oil used by many U.S. refineries, by $10 per barrel compared with last year, Exxon said.

Exxon last posted earnings of less than $7 billion the first quarter of 2010, when oil prices averaged $79 per barrel. In this year's second quarter, prices averaged $94 per barrel.

Exxon's lower earnings reflect higher drilling costs at a time of flat or declining production, analysts said. Exxon said oil and gas production fell 1.9 percent in the quarter, making it the ninth straight quarter production has declined compared with the year earlier.

Michael Kay, an analyst at S&P Capitl IQ, said in note to investors that Exxon's disappointing oil production in the quarter is casting doubts on the company's ability to hit its production goals for the 2014 through 2017 period.

Exxon's refining operations suffered in the second quarter because oil prices rose faster than wholesale gasoline prices. That narrowed the profit Exxon's refineries made because input costs rose faster than the prices received for the refined fuel.

These narrower margins reduced Exxon's refining profit by $510 million in the quarter, the company said. The company also manufactured less fuel because refineries were undergoing maintenance. That reduced earnings by $370 million.

"Refining stuck out the most, but they missed across the board," said Brian Youngberg, an analyst at Edward Jones.

David Rosenthal, vice president of investor relations, said on a call with investors that the refinery maintenance outages were largely planned, and will allow Exxon to produce more fuels in the future.

"We're looking forward to the third quarter and getting these things again back up and running and producing product," he said.

From The Princess Bride to recent revamps of Snow White, fairy tales remain prime fodder for cinematic reimagination. French actress-writer-director Agn?s Jaoui mashes up several classic narratives in the frustratingly flat Au bout du conte, leaving us wishing she had left well enough alone.

The title is play on words, meaning both ?in the end,? and ?at the end of the fable.?

Laura (Agathe Bonitzer, saving the convoluted plot with a compelling performance) has a dream in which she is wandering through the woods and swept away by a handsome prince with an angel hovering over his shoulder. That dream becomes reality when she meets budding composer Sandro (Arthur Dupont, overdoing it on the pathos) at a party.

They dance, but he has to duck out early, leaving his shoe behind. It?s a half-hearted attempt by Jaoui at showing us she?s changing the formula. If only she followed through on her promise. Laura and Sandro eventually do hook up, but there are more obstacles in their path.

The not-so-subtly named Maxime Wolf (played by Benjamin Biolay) has big eyes for Laura and makes Sandro an offer he can?t refuse regarding his orchestra.

Meanwhile, Sandro?s tight-fisted father, Pierre (Jean-Pierre Bacri, who wrote the script with Jaoui) becomes increasingly depressed after recalling that the day a clairvoyant had told him he was going to die, March 14, is fast approaching.

Laura?s aunt Marianne (Jaoui) is a pleasant lady who teaches theatre to elementary schoolchildren and who refuses to act out her fairy tale scenarios. Meanwhile, Marianne?s daughter is traumatized by her mom and dad?s recent divorce and is taking driving classes from Pierre in hopes of overcoming her fear of driving/independence.

If that?s not muddled enough, there are other unnecessary subplots in this well-meaning but unpolished affair. The point of it all is never quite made clear, inducing a feeling that the end of Jaoui?s tale can?t come soon enough.

Obama picks government trouble-shooter Koskinen to lead IRS

WASHINGTON (Reuters) - President Barack Obama on Thursday nominated John Koskinen, known as a trouble-shooter of distressed organizations, to lead the Internal Revenue Service amid a controversy over the agency's scrutiny of conservative political groups.

If confirmed by the Senate, Koskinen will take over the agency's 90,000 employees responsible for administering the increasingly complex tax code.

The IRS has been reeling since an inspector general's report in May found the agency unfairly handled applications from Tea Party and other conservative groups seeking tax-exemption.

The revelations led Obama to fire the acting IRS commissioner and put others on administrative leave, while the FBI and congressional committees began investigations.

Koskinen was in charge of the government's effort to prevent computer failures ahead of the "Y2K" bug for the year 2000. He helped manage Freddie Mac, the government-controlled mortgage funding group, during the recent financial crisis, and served as deputy mayor for Washington, D.C. during its troubled fiscal times.

"John is an expert at turning around institutions in need of reform," Obama said in a statement. "John knows how to lead in difficult times ... I am confident that John will do whatever it takes to restore the public's trust in the agency."

Koskinen will need confirmation by the Senate for a five-year term. The IRS is now being led by an acting commissioner, Daniel Werfel, appointed by Obama in May to serve through September.

When the Tea Party controversy broke, former IRS Commissioner Douglas Shulman and then-Acting Commissioner Steven Miller angered Republicans, who said they failed to take responsibility.

Werfel has had better relations with Republicans, but Dean Zerbe, a former counsel to Republican Senator Charles Grassley, said it is vital for stability that a permanent chief be in place.

"Koskinen will need all his skills and background in turnarounds as he brings his lunch pail to the IRS," Zerbe said.

He may have his work cut out for him, with a top Republican irked that Obama did not consult with him before making the announcement.

"Given the magnitude of the scandal facing the IRS, I am more than a little mystified that neither the President nor the Secretary of Treasury either consulted with or told me in advance," said Senator Orrin Hatch, the top Republican on the Senate Finance Committee, which must clear the nomination.

On Thursday, the Republican-controlled U.S. House of Representatives debated several bills to revamp rules at the agency. Some were partisan measures not likely to go far, while others were bipartisan such as one stating explicitly a "taxpayer's bill of rights."

MANY ROLES

Koskinen is known for taking over crisis situations, such as the federal government's feverish work to prevent what some said could be a technological calamity with the year change from 1999 to 2000.

He is a lawyer by training with little record of a background in taxes.

The IRS has taken over more responsibilities outside traditional tax collection in recent years, from administering refundable tax credits to playing a major role in implementing Obama's healthcare law.

On Thursday, Werfel faced hostile questions from a Republican committee on the agency's readiness to deal with its healthcare law duties. The IRS is working frantically to get systems up and running for online health exchanges by an October 1 deadline.

The IRS also is preparing to enforce a new anti-tax evasion law, the Foreign Account Taxpayer Compliance Act. The law's start date was delayed until July 2014, in part because the IRS was struggling to finish writing the implementation rules.

Congressional tax-writers are also working to revamp the tax code, now running more than 70,000 pages, though the effort faces steep odds in the hyper-partisan atmosphere in Washington.

Don?t store any items near a gas appliance that could hinder the free airflow around the device.

Clean out your clothes dryer?s lint cage after every drying cycle, and have your dryer?s vent to the outdoors checked and thoroughly cleaned every couple of years. However, there are some instances when you might want to have your duct checked and cleaned out more often. For example, the longer your vent duct is, the more likely it has build-up inside. Other factors that speed the interior collection of lint and other flammable debris include the number of twists and turns in your duct, and whether your dryer blows air out forcefully or gently.
The more softly the dryer blows, the more material will be able to collect in the dryer?s vent path.

Bank of America may face civil charges from DOJ

Bank of America may be facing civil charges over mortgage backed securities and other mortgage-related matters.

The bank said in a regulatory filing Thursday that the Department of Justice told the company that it intends to file civil charges related to one or two jumbo-prime securitizations. The SEC is also considering filing civil charges against Merrill Lynch tied to a collateralized debt obligation investigation.

Banks used to regularly package mortgages into bundles known as CDOs, or collateralized debt obligations, and then sell them off in pieces to investors. Many went sour when the housing market collapsed.

Additionally, the filing said that the New York Attorney General's office intends to file action against Merrill Lynch, following an investigation of some of its residential mortgage backed securities.

Bank of America said that it is fully cooperating with the investigations. It also said that it has been in active discussions with each government entity in to explain why the threatened civil charges are not appropriate.

Company spokesman Lawrence Grayson said that the Bank of America has "made progress resolving many issues and will continue to work to address any outstanding matters."

Societe Generale sees jump in Q2 earns

PARIS (AP) ? Societe Generale says its net profit more than doubled in the second quarter thanks to lower write-downs on past acquisitions.

The French bank reported Thursday net profit of 955 million euros ($1.3 billion) for the April to June quarter, compared to 436 million euros a year earlier when earnings were hit by writeoffs on assets in the U.S. and Russia.

However, in the first half, Societe Generale's operating profit slumped nearly 44 percent to 1.4 billion euros following a near 1 billion euro loss from the reevaluation of financial liabilities.

Societe Generale has been hit hard by Europe's debt crisis given its exposure to Greek bonds, which plummeted in value. The bank said earlier this year that it had completed a program to get rid of bad investments and loans.

Ramsay holds his tongue working with kid chefs

BEVERLY HILLS, Calif. (AP) ? Gordon Ramsay's, dare we say it, softer side comes out when the formidable chef presides over aspiring kid cooks on a new reality show.

Kids between 8 and 13 who love to work in the kitchen will face off on "MasterChef Junior" debuting Sept. 27 on Fox.

Ramsay is the expletive-spewing restaurateur and star of such Fox shows as "Kitchen Nightmares" and "Hell's Kitchen." The new show is based on a popular British series.

"I don't think I swore once," Ramsay told the Television Critics Association on Thursday.

"Twice," corrected Gavin, a 10-year-old contestant from San Francisco, adding that Ramsay's cursing was directed at servers during a restaurant challenge, not the kids.

"We know the F-word means food," Ramsay said.

The contestants knew of Ramsay's fiery reputation as a demanding taskmaster, but 9-year-old Sarah from Pacific Palisades, Calif., said, "He can't be really mean because we're kids."

Ramsay, a father of three daughters and a son, told the budding chefs when their food wasn't good enough.

"I'm brutally honest and I think the kids appreciate that," Ramsay said. "Being firm and fair isn't anything we can be short on."

To soften the blow, they were sent home in pairs during eliminations.

"We hate saying goodbye," Ramsay said. "We let them down gently."

Tommy, an 11-year-old contestant from Palos Verdes Estates, Calif., said, "He was giving us tips on making it better."

Added Gavin, "He taught you not to give up and keep on trying."

Several of the seven kids at the TCA panel said they hope to pursue careers in food when they grow up. Ramsay said he enjoyed mentoring the kids and teaching them life-long skills about eating healthy foods.

"Learning to cook for yourself is so important to set them up for the rest of their lives," he said.

Joining Ramsay on the judging panel are restaurateur Joe Bastianich and chef Graham Elliot.

The first audition round features 24 kids split into three groups of eight to create seafood, pasta or desserts.

The top 12 finalists earn a white apron and advance to a series of challenges and cook-offs, including preparing Beef Wellington as a tag-team. The kids take over a fine dining restaurant in Los Angeles to prepare a three-course meal.

The eventual winner earns $100,000.

Aaron Hernandez writes that his murder case is all a part of God's plan.

Aaron Hernandez believes that he will be acquitted of the first-degree murder charge against him, and intends on playing in the NFL again, according to a pen-pal letter allegedly written by Hernandez and obtained by TMZ.com.

In the letter to an unidentified supporter, Hernandez, who has pleaded not guilty in the death of 27-year-old Odin Lloyd, insists that his name will be cleared.

"I know everything happens for a reason and I know 'God' has a plan for me and something good will come out of this," he writes. In protest, man repays insurance money with 4 tons of coins

ST. LOUIS ??An Illinois businessman outraged by a court order that he return more than $500,000 in insurance money related to a 2001 wreck that killed his teenage son wanted to pay the money back in pennies in protest. But he soon recognized that was unfeasible.

So, Roger Herrin settled on quarters ? four tons of them.

Packed in 150 transparent sacks each weighing about 50 pounds, the $150,000 in coins were nearly one-third of the money an appellate court required Herrin to pay back to resolve years-long legal feuding among the crash's survivors over how $800,000 in insurance proceeds were apportioned.

Obtained from the Federal Reserve in St. Louis, the backbreaking load of quarters were brought in Wednesday by an armored vehicle and delivered on a flatbed truck to two law firms that represented other victims of the wreck.

"There was no satisfaction from doing that," Herrin, who also serves on the Southern Illinois University system's governing board, told The Associated Press on Thursday. "The loss of a child is the loss of a child, and all the money doesn't replace that.

"I just wanted to draw attention to what went on here," the 76-year-old man added before mustering a laugh. "I really wanted to do it in pennies."

It ended the legal wrangling that's happened since Herrin's 15-year-old son, Michael, was killed in June 2001. He was a passenger in a Jeep Cherokee that was broadsided by a truck that blew through a stop sign near Raleigh in southern Illinois' Saline County. Three other occupants of the Jeep were injured.

Roger Herrin got $1.6 million compensation through his own coverage. Of an additional $800,000 paid out through other insurance, the Herrin estate got the bulk of it because of Michael Herrin's death, with the remainder of that money distributed to survivors.

Those survivors appealed and won when the Mount Vernon, Ill.-based 5th District Appellate Court ruled against Roger Herrin, a retired foot surgeon whose business holdings include three southern Illinois nursing homes. Herrin has owned seven community banks, but he's sold those off in recent years.

Herrin complied in paying back the money, but "obviously in protest" with the plastic-sacked quarters he called "heavy as hell."

"I've had 10 years to think about this a little bit, and I'm very, very bitter at this ruling," he said. "It's wrong, and everybody knows it's wrong."

Mark Prince, an attorney for the Jeep's driver and her son, who was also a passenger, declined to discuss the case's merits Thursday, calling that "counterproductive" and a potential violation of a confidentiality agreement.

While saying Herrin's choice of repayment method was his prerogative, Prince said he did find the unannounced delivery "surprising" ? and a burglary risk for his law firm in Marion, Ill., given the media attention instantly foisted onto the thousands of dollars in coins.

"We've been on pins and needles because we had a lot of cash suddenly laying around [and] it was publicized," Prince said. "We don't have safes or vaults, and we lock our front door. Advance notice would have been nice, because we could have made arrangements to have it delivered to the bank."

Douglas Dorris, an attorney for the Jeep's fourth occupant, agreed.

"I am not going to criticize a man who lost his son, who is obviously upset with the decisions of the court," he said. "But I believe the decisions of the appellate court follow the law correctly."

Almost three in four people have said that London-based offices and rebranding are a waste of money for charities, an nfpSynergy poll of 1,002 adults has shown.

The poll was carried out as part of nfpSynergy's Charity Awareness Monitor, which surveys a representative sample of adults in Britain. Of those surveyed, 74% felt that London-based offices for charities were a "somewhat" or "very" wasteful expenditure, with just 4% saying they were "fairly" worthwhile, and the rest saying they were unsure.

Rebranding recieved a similar response, with 72% of people saying it was wasteful for charities to spend money on changing their name, logo or look, and just 9% saying they felt it was worthwhile.

Joe Saxton, founder of nfpSynergy, said: "London offices make complete sense for many charities, so they need to be honest and proactive about the benefits. Being in London provides a much better pool of staff to recruit from and the small savings outside London would be a false economy."

More than half (62%) of those surveyed said they would feel confident that a charity spends donations well if staff did not travel in first class and 55% of respondents said they would feel confident if the organisation was mostly ran by volunteers. Of those surveyed, 51% said that if nobody in the organisation was paid more than ?50,000 a year that would increasse their confidence in the charity.

In addition, close to one in five (23%) said that they would have more confidence in a charity if staff paid for their own Christmas party, while 9% felt that staff would need to work for free one day a month for them to feel confident in a charity's spending.

"Paying someone more than ?50,000 and ?100,000 [makes sense for charities]," Joe Saxton said. "If that person brings a skillset, a breadth of experience and other benefits, be proactive and tell the world about it. I think every major charity can justify paying their chief executive over ?100,000.

"What charities need to remember is that if London offices or ?100,000 salaries are worthwhile, they need to scream and shout about why. The sector needs to talk about these issues now, not hope that nobody notices what they are doing."

Online tools and lobbying recieved a more positive response, with 70% of respondents saying they felt that spending money on a website was worthwhile and over half of those surveyed saying that lobbying government and other organisations (58%), as well as advertising (67%), were worthwhile.

In addition, 48% believed that producing a magazine to update supporters on work that had been done was a worthwhile expenditure for charities.

Ex-NCAA athletes prevail in lawsuit over EA video games

(Reuters) - A divided U.S. federal appeals court rejected Electronic Arts Inc's (EA.O) effort to throw out a lawsuit by former collegiate athletes who accused the company of using their images in video games without permission.

By a 2-1 vote, the 9th U.S. Circuit Court of Appeals said EA's use of the athletes' likenesses in its NCAA Football and NCAA Basketball games did not deserve protection as free expression under the First Amendment of the U.S. Constitution.

Samuel Keller, the former Arizona State University quarterback, and eight other plaintiffs had claimed that EA used their identities and likenesses without compensation.

The decision upheld a ruling by U.S. District Judge Claudia Wilken in Oakland, California and sets the stage for Keller to seek class-action status on behalf of other athletes.

"It says that athletes do have a right of ownership in their images, even after they leave college," said Robert Boland, a sports law professor at New York University's Tisch Center. "While it doesn't change the status of athletes now in college, it begins to shape their financial rights in their images."

EA plans to appeal.

Wilken also oversees a four-year-old antitrust lawsuit led by former UCLA basketball star Ed O'Bannon, among the plaintiffs in the Keller case, over whether athletes should share in profit from the National Collegiate Athletic Association's broader use of their names and likenesses.

Billions of dollars may be at stake in that case.

In a separate decision on Wednesday, using a different legal test, the same 9th Circuit panel unanimously upheld another judge's dismissal of National Football League Hall of Famer Jim Brown's trademark case against EA over the use of his likeness in its Madden NFL video game.

RECREATING A QUARTERBACK

Writing for the Keller majority, Circuit Judge Jay Bybee said EA's games lacked "significant transformative elements" to defeat the athletes' right-of-publicity claims, and that NCAA Football "literally recreates Keller in the very setting in which he has achieved renown."

The judge noted that in the 2005 edition, Arizona State's virtual starting quarterback shared Keller's height, weight, facial features, hair color and style, home state, playing style, school year, skin tone, throwing arm, uniform number and visor preference.

He said the case recalled No Doubt's successful 2011 court challenge against Activision Blizzard Inc's (ATVI.O) use of its likeness in its "Band Hero" video game, whose expressive elements were "manifestly subordinated" to a desire to "commercially exploit" the pop group's fame.

Circuit Judge Sidney Thomas dissented, saying the majority view threatens all realistic depictions of actual people, even if those depictions are incidental.

"This logic jeopardizes the creative use of historic figures in motion pictures, books, and sound recordings," he wrote. "Absent the use of actual footage, the motion picture 'Forrest Gump' might as well be just a box of chocolates."

In the Brown case, Bybee concluded that the likeness of the former Cleveland Browns running back was "artistically relevant" to Madden NFL, and that Brown did not show that EA explicitly misled consumers about his involvement in the game.

"As expressive works, the Madden NFL video games are entitled to the same First Amendment protection as great literature, plays, or books," Bybee wrote.

The 9th Circuit took more than a year to decide both cases. The Keller decision echoed a May 21 ruling by a federal appeals court in Philadelphia that revived a similar lawsuit against EA by former Rutgers University quarterback Ryan Hart. EA is based in Redwood City, California.

"We're pleased with the outcome regarding Jim Brown's likeness, but equally disappointed with the ruling against First Amendment protection in the Keller case," EA spokesman John Reseburg said. "We believe the reasoning in Judge Thomas' dissent in that decision will ultimately prevail as we seek further court review."

Steve Berman, a lawyer for Keller, in an email said he is "pleased with the win" in his case and will pursue class certification. "No reasonable person can dispute they use the players' likeness (and) doing so violates the law," he said.

Ronald Katz, a lawyer for Brown, had no immediate comment on the decision against his client.

The O'Bannon antitrust lawsuit seeks to force the NCAA to give athletes a cut of its profits from broadcasts, memorabilia sales and other business activities featuring them.

Wilken in June heard oral arguments on whether to certify a class of thousands of athletes. She has yet to rule.

The NCAA did not immediately respond on Wednesday to a request for comment.

On July 17, the NCAA said it will not renew a contract that expires next June to license its name and logo for EA's college football game. EA stopped producing NCAA Basketball in 2010.

In afternoon trading, EA shares were up 0.3 percent at $26.16.

Lindsay Lohan will not be cast in Ben Affleck's 'Live By Night'

LOS ANGELES (TheWrap.com) - Those hoping to see "The Canyons" star Lindsay Lohan cast in Ben Affleck's crime drama "Live By Night" can keep on dreaming, TheWrap has learned.

A report on Showbiz 411 said that Lohan was "this close" to signing on to the Warner Bros. movie -- but an individual familiar with the project says that's far from the case.

"It's NOT true. She will not be cast in any role in the movie. She is not being considered for any role in the movie. She won't be in the movie," said the Hollywood insider, who added that no one has been cast aside from Affleck himself.

Based on the novel by "Mystic River" author Dennis Lehane, "Live By Night" chronicles the rise of a gangster in prohibition-era Boston who spends time in prison and starts his life over in Florida, only to be caught between two rival gangs and two women.

Lohan can currently be seen alongside adult film star James Deen in Paul Schrader's "The Canyons," which was written by Bret Easton Ellis.

Affleck is set to star opposite Rosamund Pike in David Fincher's "Gone Girl."

Android 4.3 Starts Hitting Galaxy Nexus Phones

Android 4.3 was finally made official, and usually updates start rolling out that very same day. It is taking a little longer for the update to hit even Nexus 4s out there, but word has it that international Galaxy Nexus users have started to receive the Android 4.3 update.

There have been early builds for the Verizon Galaxy Nexus that have been conjured up, which of course needed to happen because we know how Verizon loves to take their time when it comes to updates. So I would keep an eye on your system updates in the next couple weeks. First the newer Nexus devices will receive the update, then the good ole? Galaxy Nexus will get its update next. Let us know if you see anything.

Flipnote Studio 3D delayed in Europe due to 'unexpectedly high' use in Japan

European 3DS owners hoping to flip some 3D notes this week will have to wait a bit longer. Flipnote Studio 3D was coming to the continent this week, but Nintendo postponed the animation software's launch in light of "unexpectedly high" uptake in Japan after last week's launch over there. Nintendo of Europe provided us with the following statement:
"Nintendo of Europe regrets to announce that Flipnote Studio 3D, originally due for a European launch on Nintendo eShop for Nintendo 3DS on 1st August, will be delayed. Due to unexpectedly high levels of user activity since the launch of the application in Japan on 24th July, we decided to postpone our European launch until we can deliver the best possible service to users. We apologize for any inconvenience this delay may cause, and will announce a new launch date as soon as possible."
We've reached out to Nintendo of America to find out if the European delay will impact the North American launch, which remains listed as "early August" on the software's website. When it does launch, the free 3DS successor to Flipnote will bring with the ability to use 3D effects, doodle in six colors - yes, six - and export creations as AVIs and GIFs. And if there's anything the Internet needs, it's more GIFs ...

No, we're not joking.

Eau Claire 2nd in nation in construction jobs

EAU CLAIRE, Wis. -

New figures show Eau Claire is second in the nation in the percentage of new construction, mining and logging jobs.

The Associated General Contractors of America compared last month to June of 2012. Only Pascagoula, Miss., was stronger with a 33 percent gain in construction jobs tied to busy shipyards.

The Eau Claire area had 4,200 jobs in the construction category in June, up 31 percent from a year earlier. Officials say more construction at the University of Wisconsin-Eau Claire, manufacturing plant expansions, highway work and a new county jail were all factors in the employment surge.

Eau Claire Economic Development Corp. executive director Brian Doudna told the Journal Sentinel a frack sand processing plant was also built in the last year.

Texan gets another wrong water bill topping $66K

(AP) ? A Dallas man says he's shocked to have been swamped with a nearly $67,000 erroneous water bill a few months after a similar computer error.

Tom Hoffman says he is looking forward to getting a new bill after the latest mistake that Dallas officials blame on a bad water meter.

WFAA-TV (http://bit.ly/1e853CN ) reported Monday that Hoffman canceled his auto-payment system earlier this year after getting a water bill for more than $66,000. Hoffman's financial accounts were frozen before the error was fixed.

Now it's happened again.

City of Dallas spokesman Frank Librio says the stuck meter has been replaced and accurate billing will follow.

Librio also apologized for the error and the inconvenience to Hoffman.

China's Bo to plead guilty, but maybe not to all charges: sources

BEIJING (Reuters) - Disgraced Chinese leader Bo Xilai has agreed to plead guilty at a trial likely to be held within weeks, three sources said, in an apparent bid to earn a more lenient sentence and allow authorities to close the door on the country's biggest political scandal in decades.

But it was not clear if he would plead guilty to all or only some of the charges of accepting bribes, corruption and abuse of power.

Bo's downfall is the country's most divisive political scandal since the 1976 downfall of the Gang of Four at the end of the Cultural Revolution.

President Xi Jinping is keen for Bo's trial to go off smoothly as he pushes major economic reforms ahead of a closed-door party plenum in September or October where he will need unstinted support from the party.

Reuters reported in February that Bo, one of the Communist Party's high-flyers who fell from grace in early 2012, had refused to cooperate with government investigators, staged a hunger strike twice and refused to shave his beard in protest against what he deemed unfair treatment.

"Bo Xilai had initially refused to admit guilt and insisted on defending himself," said a source with ties to the leadership and direct knowledge of the matter, requesting anonymity due to the political sensitivity of the case.

"But in a change of heart, he cooperated and will plead guilty (at his trial) in the hope that he will receive a relatively lenient sentence," the source told Reuters.

It remains to be seen if his decision to plead guilty will hold until the trial.

In China, defendants are presumed guilty until proven innocent and those who refuse to cooperate are often given harsher sentences.

Other sources indicated Bo may not plead guilty to the abuse of power charge.

A source close to the family, who also spoke on condition of anonymity, said Bo will plead guilty, but should not be held accountable for crimes committed by immediate family members. The source declined to elaborate.

The abuse of power charge is believed to be linked to the murder of British businessman Neil Heywood by Bo's wife, Gu Kailai, when Bo was the party chief in sprawling Chongqing city.

Gu was convicted of the murder last August and Bo's police chief, Wang Lijun, was jailed for trying to cover up the crime.

A third source, also with ties to China's leadership, said Bo will plead guilty to accepting bribes and corruption while he was mayor and Communist Party boss of the northeastern city of Dalian between 1992 and 2000.

But Bo will deny the charge of abuse of power when he was party boss of Chongqing, the source added.

"By pleading not guilty to the abuse of power charge, Bo wants to show that he is a victim of a power struggle," the source told Reuters, also requesting anonymity. The source did not elaborate.

After his appointment as party boss of Chongqing in 2007, Bo turned the region into a showcase of revolution-inspired "red" culture, as well as state led economic growth. He also won national attention with a crackdown on organized crime.

Bo's populist ways and crime clean-up were welcomed by many of Chongqing's 30 million residents, as well as others who hoped Bo could take his Maoist policies nationwide. But his ambition and brash self-promotion irked some top leaders.

Bo's lawyers Li Guifang and Wang Zhaofeng did not answer telephone calls seeking comment on what his strategy will be at the trial.

He will be represented in court by his family-appointed lawyer Li, as opposed to having a state-appointed attorney forced upon him as happened to his wife, a fourth source with direct knowledge of the case told Reuters.
